COMPUDOC COMPUTER SERVICES – HOSTING TERMS AND CONDITIONS

(Aligned with South African law: CPA, ECTA, POPIA)

These Terms and Conditions govern the provision of hosting and related services by Compudoc Computer Services to its customers. By ordering, using, or continuing to use the services, the customer agrees to be bound by these terms.

  1. DEFINITIONS AND INTERPRETATION

1.1 "Service Provider" means Compudoc Computer Services, operating from Shop 10, Campbell Street Centre, Campbell Street, Port Alfred, 6170, Eastern Cape, South Africa.

1.2 "Customer" means any natural or juristic person who subscribes to or uses the services.

1.3 "Services" means hosting, email, domain management, and related services provided by the Service Provider.

1.4 These terms are drafted in plain language as required by the Consumer Protection Act, 68 of 2008 (CPA).

  1. HOSTING PLANS AND SERVICES

2.1 Shared Hosting Plans

All shared hosting plans are provided on an annual subscription basis.

Available plans and limits are as follows:

  • Basic Plan: • 2GB storage quota • 20GB monthly bandwidth

  • Standard Plan: • 5GB storage quota • 50GB monthly bandwidth

  • Professional Plan: • 10GB storage quota • 100GB monthly bandwidth

  • Enterprise Plan: • 20GB storage quota • Unlimited bandwidth (subject to fair and reasonable use)

The storage quota includes all website files, databases, email accounts, and associated data.

2.2 Dedicated Hosting

Dedicated hosting services are custom-built to customer requirements and are subject to separate terms and pricing.

  1. PAYMENT TERMS

3.1 Billing

Services are billed annually in advance. Invoices are issued approximately thirty (30) days prior to the expiry of the current service term.

3.2 Payment

Payment must be received before the commencement of a new service term. Failure to pay by the due date may result in suspension of services.

3.3 Suspension for Non-Payment

If payment is not received by the expiry date:

  • Hosting services may be suspended;

  • Email services may be disabled;

  • Domains managed by the Service Provider may be placed under administrative hold strictly in respect of unpaid domain-related fees.

Domain ownership remains vested in the registered registrant at all times. Domain transfers will not be processed while domain-related fees remain outstanding.

  1. SERVICE SPECIFICATIONS

4.1 Hosting Environment

The hosting environment includes:

  • Linux-based servers

  • MySQL database support

  • PHP support

  • Email services including IMAP, POP3, SMTP, and webmail

4.2 Storage Management

Each hosting plan has a fixed storage quota which applies collectively to:

  • Website files

  • Databases

  • Email accounts

  • All other stored data

When the allocated quota is reached:

  • Incoming email may be rejected;

  • FTP and web disk uploads may be blocked;

  • Certain hosting functions may cease until storage is reduced.

System notifications are issued at approximately 80% and 100% usage levels.

4.3 Control Panel

A basic control panel is provided for email management, password changes, auto-responders, quota monitoring, and basic statistics. Additional configuration changes require a support request.

  1. CUSTOMER RESPONSIBILITIES

5.1 Backups

The Service Provider does not provide automated backups unless expressly agreed in writing. The Customer is solely responsible for maintaining backups of all data, including websites, databases, and email.

Backup guidance links are provided for convenience only and without warranty.

5.2 Resource Usage

Bandwidth usage is monitored monthly. Excessive or unreasonable consumption of server resources may require an upgrade or corrective action to protect service stability for all customers.

  1. DOMAIN MANAGEMENT

6.1 Domain Registration

Domain names are registered in the name of the Customer as registrant. The Service Provider acts as the administrative and technical contact for management purposes only.

Domain registration and renewal fees are separate from hosting fees and must be paid in advance to maintain registration.

6.2 Administrative Control

Domains may be placed on administrative hold for non-payment of domain-related fees only. Administrative holds will be lifted once all applicable domain fees are settled.

  1. SERVICE LIMITATIONS

7.1 Technical Limitations

  • No shell (SSH) access is provided

  • Resource-intensive scripts may be restricted or disabled

  • Only standard server configurations and PHP modules are supported

  • Custom server configurations are not available on shared hosting

  1. SUPPORT

8.1 Scope of Support

Technical support is limited to hosting infrastructure and service availability. Support is provided via email during normal business hours.

The following are excluded from hosting support:

  • Website design or development

  • Content management

  • Application development or troubleshooting

  • Script debugging

  • SEO or marketing services

Separate agreements are required for additional services.

  1. DATA PROTECTION AND PRIVACY (POPIA)

9.1 The Service Provider processes personal information on behalf of Customers as an "operator" as defined in the Protection of Personal Information Act, 4 of 2013 (POPIA).

9.2 Reasonable technical and organisational measures are implemented to safeguard hosted data against unauthorised access, loss, or damage.

9.3 Customers remain responsible for compliance with POPIA in respect of the personal information they collect and store using the services.

9.4 In the event of a data security compromise affecting hosted data, the Service Provider will notify affected Customers within a reasonable time.

  1. CHANGES TO SERVICES AND TERMS

10.1 The Service Provider may update or modify the hosting environment to maintain security, performance, and compliance with best practices. Critical security updates may be applied without prior notice.

10.2 Material changes to these Terms and Conditions will be communicated to Customers in advance where reasonably practicable. Customers may cancel the service if they do not accept material changes, subject to CPA provisions.

  1. TERMINATION AND CANCELLATION

11.1 The Customer may cancel a fixed-term agreement by providing at least twenty (20) business days’ written notice, subject to a reasonable cancellation penalty as permitted under the CPA.

11.2 The Service Provider may terminate services for material breach of these terms.

11.3 Upon termination, data may be permanently deleted after a reasonable retention period. Customers are responsible for securing their data prior to termination.

  1. LIMITATION OF LIABILITY

12.1 To the maximum extent permitted by law, the Service Provider shall not be liable for indirect, incidental, or consequential losses, including loss of data, income, or business opportunity.

12.2 Nothing in these terms limits liability for gross negligence or willful misconduct.

  1. GOVERNING LAW AND JURISDICTION

These Terms and Conditions are governed by the laws of the Republic of South Africa. The parties consent to the jurisdiction of the Magistrate’s Court having jurisdiction, notwithstanding the amount in dispute.

  1. ECTA DISCLOSURES
